What is an executorship?
The administration of deceased estates generally involves the process of winding up the affairs of a deceased person, and it is governed by the Administration of Estates Act, 66 of 1965 (as amended). The duties and processes to finalise a deceased estate must be fulfilled by a person appointed by the Master of the High Court. This person is referred to as the executor of the estate and they take on the executorship role. Once appointed by the Master, the executor can act on behalf of the deceased as if they were that person, to finalise their affairs, including distributing their assets.
