How do I claim from a deceased estate?
A 'claim' against a deceased estate refers to a creditor claiming for outstanding debt against the deceased estate. According to South African law, a creditor has two opportunities to lodge such a claim. The executor overseeing the estate administration process must place ads in the Government Gazette and local newspaper (in the area of the deceased’s last residential address). These ads are placed shortly after the date of death and when the Liquidation and Distribution (L&D) account is ready for inspection, by anyone, at the relevant office of the Master of the High Court. The L&D is available for inspection for 21 days. These are the two opportunities when creditors can claim against the deceased estate.
